• attempt unauthorized access to the Site, accounts, or systems

• use any automated means (bots/scrapers) that disrupt the Site

• submit content that is unlawful, threatening, defamatory, harassing, obscene, or misleading

5) Intellectual Property

Unless otherwise stated, all content on the Site—including text, graphics, logos, photos, videos, designs, and downloadable materials—is owned by or licensed to us and is protected by applicable intellectual property laws.

You may share Site content for personal, non-commercial use (for example, posting a link on social media). You may not reproduce, modify, distribute, or sell Site content without our prior written permission.

6) Information You Submit

If you submit information through the Site (including contact forms, volunteer sign-ups, RSVPs, or other submissions), you agree that the information you provide is accurate to the best of your knowledge and that you have the right to provide it.

To the extent you submit non-personal content (for example, a testimonial or message intended for publication), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content for campaign purposes (including online, email, and social media), unless you clearly request otherwise in writing.

7) Donations and Contribution Disclosures

If the Site accepts online contributions, you agree that any contribution you make is lawful and made using your own funds and not those of another person.

By contributing, you confirm that:

• you are at least 18 years old (or otherwise legally able to make political contributions under applicable law)

• you are a U.S. citizen or lawfully admitted permanent resident (as required by federal law for political contributions)

• you are not a federal government contractor (if applicable)

• your contribution is made from your own personal funds and not from the funds of a corporation, labor organization, or another prohibited source

• you understand contributions may be subject to limits and reporting requirements under applicable law

We may reject, return, or refund any contribution that we believe cannot be accepted under applicable law, cannot be properly attributed, or otherwise must be returned.

Refund Policy: Contributions are generally not refundable unless required by law or if a contribution is returned because it cannot be accepted.

Payment Processing: Online contributions may be processed by third-party vendors. Your transactions may also be subject to the vendor’s terms and privacy practices.

8) Text Messages and Email Updates

If you opt in to receive text messages or emails from the Frances Holk-Jones Campaign, you consent to receive recurring communications, including fundraising, informational, and event-related messages.

We may take photos and videos at campaign events and may use them for campaign communications and promotional purposes, including on this Site and on social media. If you have a concern about a specific image, email info@votefrances.com.

The Site may contain links to third-party websites (including social media platforms and payment processors). We do not control those sites and are not responsible for their content, policies, or practices. Use them at your own risk.

11) Disclaimer

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee that the Site will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

12) Limitation of Liability

To the fullest extent permitted by law, the Frances Holk-Jones Campaign and Friends of Frances Holk-Jones will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of (or inability to use) the Site.

13) Indemnification

You agree to indemnify and hold harmless the Frances Holk-Jones Campaign, Friends of Frances Holk-Jones, and our staff, volunteers, agents, and representatives from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your submissions, or your violation of these Terms.

14) Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any dispute arising under these Terms will be brought in the state or federal courts located in Alabama, and you consent to jurisdiction and venue in those courts.

15) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
